Is Barrick Gold – Acacia Mining about to STING President Magufuli & the Tanzania Nation?

Dear Hon. President Magufuli

Last week, after the President’s meeting with John Thornton, we wrote a letter to you that we believe there is another agenda to Barrick’s sudden and urgent need to meet the President. We wrote Chui hageuki madoadoa – A leopard cannot change its spots and according to the media reports over the past few days, we see how correct we are about these Canadian and British millionaire businessmen.

Only five days ago, the following words from the Hon. President were quoted in the media worldwide:
If they (Acacia Mining) accept that they stole from us and seek forgiveness in front of God and the angels and all Tanzanians and enter into negotiations, we are ready to do business.” Even as Thornton flew across the world in his private jet, he could have thought long and hard about the Hon. Presidents words about the need to accept the theft and to seek forgiveness. We believe there was only one thought in Thornton’s head – to put on the best show for the world media so the company shares turn around and go up and the stock exchange analysts start looking positively again on Barrick Gold and Acacia Mining.

Thornton’s comments in his press release after meeting the President was telling us they will look at every claim of our Presidents two Committee reports and they discuss one claim after the next. He promised NOTHING else.
Mr. President, CHUI HAGEUKI MADOADOA and they will fight us and argue and dispute and use their media power to fight Tanzania. We can already see their arrogance and aggression in the media this weekend.

Please look at how they feed “The Economist” in London with lies and terrible insults about the Hon. President. And such insults not even 48 hours after the Barrick boss was hosted so warmly and elegantly by the Hon. President.
Is this the way they demonstrate “… accept that they stole from us and seek forgiveness in front of God and the angels… “?

The Economist in London wrote that the Hon. Presidents gesture to Thornton “could hardly have been more fork-tongued.” What a disgusting insult to the Hon. President!
Google defines “fork-tongue” as: to deliberately say one thing and mean another or, to be hypocritical, or act in a duplicitous (two-faced) manner. 
Mr. President, do those people have no shame as to be so insulting? The Economist goes on to describe Tanzania as having “… initially wooed (Barrick) into the country by generous tax concessions.” As if to say there was no gold here and let’s not talk about the hundreds of millions (billions?) of US Dollars of dividends to overseas shareholders whilst they defraud our country of the little export royalty that should be paid. Thornton received warm hospitality from the Presidency and they feed these lies to the media? If anyone here is two-faced, it is Barrick – Acacia!

Even worse, Mr. President, please look at what Brad Gordon, CEO of Acacia Mining said in a telephone interview with MiningMx (a South African media company) the day after Thornton’s meeting with the Hon. President:
Brad Gordon rejected the claims made in a report by Bloomberg – that Barrick is ready “to pay all the money it’s expected to pay Tanzania”. Who is fork-tongued?
Also, Gordon said negotiations had yet to begin and the negotiating teams from both sides had yet to be appointed. So we see again (same as I wrote last week – they will continue to fight and dispute).
Also, Gordon said Acacia’s response to these assessments and allegations had not changed from the statement issued on June 12 in which Acacia said: “Acacia strongly refutes these new unfounded allegations. We have always conducted our business to the highest standards and operated in full compliance with Tanzanian law.” Who is fork-tongued? Barrick boss comes supposedly with one agenda (which is a lie anyway) and the Acacia boss has another agenda with no shame at all.
Finally, Gordon said “John Thornton wanted to experience the situation on the ground for himself and that’s why he was in the country.” Thornton did not come to Tanzania to fix the situation. He came to fix and boost their share prices!

Mr. President, Tanzanian’s were shocked on Wednesday after the meeting with Thornton when Mr. Ian Myles, Canada’s High Commissioner in Dar es Salaam said to reporters (on the video):
Canada is very proud that it expects all its companies to respect the highest standards, fairness and respect for laws and corporate social responsibility. We know that Barrick is very much committed to those values.
It is so insulting that these Canadians and British still think they can trick us with their fancy nonsense “spin” politics and dishonesty. What values is Barrick committed to? Have our nation not witnessed with our own eyes killings? rape? arson and burning our homes? destruction to our environment? poison in our water? corruption? fraud? hundreds of legal cases with local Tanzanian companies who are abused, bullied and suffer? and the list goes on. What “values” is Ambassador Myles boasting about? How dishonest and unethical to stand there and lie about values. He should rather say NOTHING because every country where Barrick operates has a long, long list of illegal activities and crimes.

Chui hageuki madoadoa – A leopard cannot change its spots. 

The Tanzania People are behind you, Mr. President. Barrick will arrive with the most expensive specialists and lawyers and accountants that money can buy. Their intention and focus will be to belittle our two President’s Committee who prepared the two mineral reports. We trust that the Hon. President will prepare to have a Team of similar standing, experience and know-how, to oppose these Godless, shameless Canadians and British who have little or no values, standards, fairness nor respect for laws and corporate social responsibility.

May God bless our President with wisdom and understanding to see through these vicious business people who prey on our land, on our minerals and on our People.

CAN TANZANIA & ACACIA MINING / BARRICK REACH SOLUTIONS WHEN ACACIA’S MAIN P.R. SUPPORT PEOPLE ARE EXPOSED AROUND THE WORLD AS CORRUPT, FRAUDS, FAKE-NEWS AND WORSE?

Dear Hon. Dr. Magufuli

We all in Tanzania stand behind you to bring solutions to the crisis of Acacia Mining and their threats to close their mines (which very few believe) due to their fraudulent and dishonest exports of the mineral gold ore from their mines.  On the one hand, Acacia Mining should be strongly forced to pay penalties and back taxes and export royalties for the decades that they exported the mineral ore.  On the other hand, we care about our People and want companies to succeed and give our workers jobs and contribute to our communities.   This is a very difficult and delicate situation and Tanzanian’s would not want anyone one else to bring solutions except for you, Mr. President.

It is very disturbing that Acacia Mining’s public announcements even in their website, are all including their Public Relations and Media advisors, Bell Pottinger.

Mr. President, earlier this year, when Acacia were advertising around the world that they are discussing a merger with Endeavour Mining, we wrote to you with factual research about Endeavour Mining and their owners and their top management.  Praise the Lord for Tanzania that Endeavour did not proceed with the merger.

Now, we have another situation of better the devil we know than the devil we don’t know.  This Bell Pottinger company from London, UK, has been referred to in the media as “The Devil’s representative worldwide.”  Truly frightening words for us in Tanzania.  And they sit side by side with Acacia Mining and Bell Pottinger even sign Acacia’s announcements, including their contact details!

SO WHY ARE ACACIA’S ADVISORS REFERRED TO AS “THE DEVIL’S REPRESENTATIVE…”?

Following are only some of the research found in the internet.  There is much more:

Media reports openly state that Bell Pottinger (BellP) are/were consultants and/or advisors for the dictators of Chile, Sri Lanka, Thailand, Belarus, Bahrain, Egypt and Syria.  If that is not enough, BellP also work for the polluting oil company, Trafigura and, most recently, the fracking company (underground gas & oil exploration that is proven to destroy the environment), Cuadrilla Resources.

Mr. President, if the above is not bad enough, BellP are deeply linked to the corruption, fraud and protection of the Gupta-Jacob Zuma financial scandals that are tearing South Africa apart.  It is published that the Gupta’s were paying BellP over US$125,000 every month to support and cover up what Gupta’s and Zuma were doing in South Africa.

One must wonder (and worry) about the US$460 million that Jacob Zuma deposited in Dubai last month (from the Gupta’s).  And BellP were there all along supporting the corruption and fraudulent operations.

A Radio station in South Africa reported on their website that Victoria Geoghegan, a partner at London-based BellP, has made it her business to undo the work of NELSON MANDELA, DESMOND TUTU and other freedom struggle supporters who built up South Africa following decades of conflict and hardship in the apartheid era.
“Madiba” Mandela, Tokyo Sexwale, Ahmed Kathrada and many other anti-apartheid activists sacrificed the best years of their lives in jail hardships in order to deliver a better future to the oppressed black majority of South Africa.
It has taken only a few years for Victoria Geoghegan and BellP to help bring South Africa to its knees.

The Radio station’s website reports:
“There is no way to put it nicely: Victoria Geoghegan represents all that is rotten with the public relations industry and public companies fuelled by short-term shareholder greed. It is hard to imagine a more evil operation than Bell Pottinger.”

The Citizen media website (in South Africa) reported that BellP worked to divide Jacob Zuma’s opposition based upon racial lines.  This actively creates an even more violent society, especially at a time when it is difficult to separate fact from false news.

Biznews.com exposed last week that BellP was hired by the Gupta’s to organize a campaign to create the monster of white monopoly capital in South Africa.  Their strategy to highlight the beast of white monopoly capital in the media and at political rallies is designed to build animosity towards critics of President Zuma and his clique and shift blame for the country’s economic woes away from those in political control.

The Huffington Post questioned if BellP helped get rid of the ex-Minister, Pravin Gordhan? The report continues saying  BellP’s notorious black ops may have prepared the ground for the former finance minister’s axing in which the former finance minister, Pravin Gordhan, was fired due to BellP’s fake news campaign?

According to South African lawyers, BellP was a key player in a conspiracy that distributed manufactured evidence to attack innocent parties. Among them the corruption allegations against former deputy finance minister Mcebisi Jonas.

Mr. President, how can BellP be part of our future Acacia Mining solutions when they stand for the exact opposite of our new Tanzania?

Now we move to the USA:
In 2016, investigations revealed BellP was paid by the USA Pentagon around USA$540 million for top secret Iraq propaganda.   This included the creation of fake videos and other forms of propaganda to assist the US military and also to smoke out al Qaeda operatives.

Journalists from the Bureau for Investigative Journalism wrote:  “Bell Pottinger produced reams of material for the Pentagon, some of it going far beyond standard communications work”.

In the first media interview any BellP employee has given about the work for the US military in Iraq, video editor Martin Wells said his “time in Camp Victory (in Iraq) was shocking, eye-opening, life-changing.”

Now we move to the UK:
The Independent reported that Tim Fallon was exposed in a company expenses fraud at BAA.  On top of the fraud, Fallon was reported to have forged his boss’s signature!
The fraud involved expenses also relating to a general election campaign (for the British Parliament).  Later, Fallon became a director of Bell Pottinger.

In another report by The Independent, the Wikipedia founder Jimmy Wales, attacked Bell Pottinger for ‘ethical blindness’.  BellP were caught and they admitted altering details of BellP’s clients’ reputations online.  It was reported that hundreds of entries on the Wikipedia site were changed by Bell Pottinger without the subjects’ knowledge.

The report said that the digital team at BellP used a number of false user-accounts to edit Wikipedia articles. Mr. Wales was quoted saying:  “I am astonished at the ethical blindness of Bell Pottinger’s reaction. That their strongest true response is they didn’t break the law tells a lot about their view of the world, I’m afraid.  The company (BellP) committed the cardinal sin of a PR and lobbying company of having their own bad behaviour bring bad headlines to their clients, [and] did so in a fashion that brought no corresponding benefits.”

Still in the UK, The Independent exposed the scandal that BellP senior executives were caught on camera boasting how they influence the British Prime Minister.  The BellP executves were secretly recorded boasting about its access to the heart of the Government and how it uses the “dark arts” to bury bad coverage and influence public opinion.

An undercover investigation by the Bureau of Investigative Journalism, published in The Independent, taped the senior executives at BellP.

Mr. President, how can BellP be part of our future Acacia Mining solutions when they stand for the exact opposite of our new Tanzania?

Now we move to Malaysia:
Media reports openly exposed Taib Mahmud, the Governor/Chief Minister of Sarawak state in Malaysia for hiring BellP to falsely and illegally alter Wikipedia entries about themselves, their companies, Sarawak state and many others.

The false changes that BellP arranged for Taib included for himself, Sean Murray (Taib’s son-in-law), Ridgeford Properties (the Taib family company in the UK), Christopher Murray (Sean’s cousin and the Director of Ridgeford Properties), Sakto (the Taib family company in Canada), Sarawak (which Taib largely owns in Malaysia) and Clare Rewcastle Brown, (ex-UK Prime Minster Gordon Brown), editors of blogs, Radio Stations, and more.

Controversies of corruption and fraud followed Taib for decades that he was Governor of Sarawak state.  BellP was there to support him.

Now we move to Serbia:
The Open Source Investigations website exposed that BellP was linked to Serbia Prime Minister Vučić who was caught for corruption – he illegally used public funds for political campaign.

BellP was exposed of “cleaning” the PM’s profile on the internet.
Then the Serbian government lied when it denied being the BellP’s client.
The fact is that BellP is working for and supporting Serbia PM Vučić’s dictatorial regime.

Now we move to Malawi:
The Nyasa Times revealed that ex-President Joyce Banda committed Malawi illegally into an arms deal with the South African arms dealer, Paramount Group.  They are reported as having purchased patrol boats for Lake Malawi.  The whole deal with Paramount Group was corrupt and illegal.  Later, it was reported that the President even bypassed the Ministry of Finance and even concealed even from the Malawi parliament!
The Mail & Guardian reported that the purchase was not even passed by government’s procurement committee.

Even worse, it is estimated that up to US$250 million may have been lost through allegedly fraudulent payments to businessmen for services that were not rendered.  Reports exposed that computer records of some transactions carried out between July and September 2013 were deleted.

Another corruption scandal was the exposure of the Malawi Presidential private jet that President Banda sold to a Paramount Group off-shore company and yet, President Banda had free unlimited use of the jet!

Reports stated openly President Banda realized that her time in the presidential seat may soon come to an end, so she followed the footsteps of other corrupt African leaders and stole from her country.  And there was BellP to support her, to guide her, to help her and to “polish her image”.  The London-based Daily Telegraph reported that payments for BellP’s services came in a round-about way from Paramount Group – in other words, payment for these patrol boats included payment for BellP’s services.

Is it a surprise that BellP sign off on media announcements of Paramount Group – without any shame of including their name and contact details?  The deeper one digs, the more the story smells – and BellP was there, all the way!

Now we move to Panama:
Last year, The Star website exposed Victor Dahdaleh, British-Canadian billionaire as the  “mysterious middleman in corruption schemes that enriched himself with US$ 400 million and he paid tens of millions of dollars in bribes.

The US Department of Justice (DOJ) linked Dahdaleh to Alcoa, one of the world’s largest aluminum companies.   In 2014, Alcoa was forced to plead guilty in the corruption for paying “millions of dollars in bribes through an international middleman” in violation of the Foreign Corrupt Practices Act.  That middleman was Dahdaleh.

In addition to the DOJ guilty verdict, Alcoa also settled with the U.S. Securities and Exchange Commission (SEC) and was slammed with one of the largest anti-corruption fines ever — US$ 384 million.  In a plea agreement with the SEC, Alcoa admitted its involvement in the corruption scheme which “facilitated at least $110 million in corrupt payments to Bahraini officials” – of course through Dahdelah.
And who was there to support and assist Dahdelah through the crisis?  None other than BellP.

Besides the above disgusting, corrupt, illegal and unethical story, it is no surprise that Dahdaleh and Peter Munk, ex-owner of Barrick Gold feature together in a multitude of media reports over the years.  Who can argue that “birds of a feather flock together”.

Now we move to Sri Lanka:
The Sri Lanka Civil War was about 3 decades long, it was cruel, fierce and unbearable by any means and independent reports estimated the number of civilian’s dead exceeded 100,000.
The Washington Post reported that President Mahinda Rajapaksa took the war to the opposition with unprecedented ruthlessness and single-mindedness.  The campaign, referred to as “scorched-earth” cost tens of thousands of lives.
A U.N. report called for an investigation into war crimes by both sides, accusing the Sri Lankan military of indiscriminate shelling and denying civilians access to humanitarian aid.

The Colombo Telegraph exposed the direct involvement of BellP in President Rajapaksa’s office.  “Senior executives at Bell Pottinger told undercover reporters that they were so influential (with the President) that they had written a key speech given by the Sri Lankan President to the United Nations” The Independent says.
David Wilson, ex-BellP Managing Director, was quoted as saying “We had a team working in the President’s office. We wrote the President’s speech to the UN…..”
Why are BellP so proud to be advisors to dictators and cruel regimes?

Mr. President, how can BellP be part of our future Acacia Mining solutions when they stand for the exact opposite of our new Tanzania?

Now we move closer to home, to the Dem. Republic of Congo (DRC):
Soco International, one of the UK’s 200 largest public companies, is a British oil company.
Global Witness exposed Soco International making illegal payments to DRC rebels and a local MP for lobbying in its favour. Also, Soco appear to have paid off armed rebels and benefited from fear and violence fostered by government security forces in eastern Congo, as they sought access to Africa’s oldest national park for oil exploration.  Bribery and corruption at its best!
Activists and park rangers opposing Soco’s oil exploration in the DRC National Park have been badly beaten.  Human rights crimes!

Now we move to Syria:
The Syrian civil war conflict is now over six years old.  The website, www.iamsyria.org, reports the death count in Syria as 470,000 of which 55,000 are children.  Do we have to say another word about the President Dictator Assad regime?  No words can describe such a tragedy and loss of humanity in every sense of the word.

The Independent reported that BellP worked for Assad’s wife, Asma, to create “a friendlier image of the Assad family”.  Only God knows how that would be possible but BellP took the job.  After all, why not – the Assad regime is similar to their other clients?

Now we move to Uzbekistan:
The media is full of reports that President Dictator Islam Karimov who held power from 1991 until his death last year, was amongst the worst dictators in modern day history.  Karimov was responsible for killings, human rights violations and child labour.

And BellP was right there, without any shame, to support and assist the Uzbek government.  The annual fee offered by the Uzbek officials to BellP was about £1 million (in those years, that was equal to US$ 1,5 million).  BellP was willing and ready to work for that sick regime!

Now we move to Ivory Coast:
Trafigura is a UK company and oil trader. Trafigura planned and carried out the dumping of hundreds of tons of toxic oil waste in a densely populated area of the Ivory Coast, with devastating effects. It was almost immediately called one of the worst pollution disasters in recent history. Any journalist who tried to report this was gagged using legal threats and demands for the correction and removal of media articles and programmes.

Thousands of West Africans were hospitalized and many died. Of course, the UK executives at Trafigura publicly claimed the dumped toxic oil waste was “harmless”.  Official local autopsy reports on 12 alleged victims showed fatal levels of the poisonous gas hydrogen sulphide (that was one of the lethal byproducts in the toxic oil waste.  Greenpeace and Amnesty International launched a legal action in Amsterdam against Trafigura, calling for the oil firm to be prosecuted there for homicide or grievous bodily harm. It said: “This intentional pollution … has caused many people to suffer serious injuries and has even led to death.”

British lawyers, representing 31,000 Africans, started legal action against Trafigura.  But we know (even here in Tanzania) British companies have deep pockets for long, long legal battles.  Trafigura fought in the courts for 3 years.  The Guardian reported, after three years of fighting in court, that dozens of damning internal Trafigura emails were exposed and revealed how the London-based company employers were told in advance that their planned chemical operation, a cheap and dirty process called “caustic washing”, generated such dangerous wastes, it was widely outlawed.  Even Claude Dauphin, the managing director, was pre-warned by the London manager, Naeem Ahmed, at that time.
But Trafigura still proceeded with their fatal plans that would destroy tens of thousands of families and so much of West Africa’s marine environment.

Finally, after 3 years of legal battle, and exposure of the internal emails, Trafigura eventually paid out damages of more than £100 million (at that time, approx US$ 150 millon).
And BellP was right there, without any shame, to support and assist Trafigura.

Mr. President, how can BellP be part of our future Acacia Mining solutions when they stand for the exact opposite of our new Tanzania?

The list goes on and on.  Same pattern, different country, same BellP scenario.

One could argue that Bell Pottinger is not doing anything illegal.  The fact that they are being paid to “protect” and “support” those who are acting illegally, what does that tell us?  They are side by side with Acacia Mining.  How can we find solutions when the clouds of crime against human rights, illegal dealings, bribery, corruption, dishonesty, immorality and total lack of ethics, all hang over Acacia Mining with these Bell Pottinger people right there ?

Maybe the cherry on the top of the cake is the knowledge that Acacia Mining’s UK lawyers, Quinn & Emanuel, they are the same lawyers that sent us the threaten letter, they are listed in multiple media reports that they ALSO are linked to working with Bell Pottinger.  Some might ask if this whole collection of people/companies is one big collection of toxic waste?

An open and public letter to Barrick Gold Chairman, John L. Thornton

Dear Mr Thornton

We, the simple Tanzanian volunteers against corruption and fraud, wrote quite a few emails to you, to Kelvin Dushnisky, Brad Gordon & other senior directors and managers,
about the mess you and your company are making in our country.

You preferred to block our emails “as spam” because it did not suit you, White money-people, to hear the truth from simple Black non-money people.
Instead you sent security investigators to find us and when that failed, you sent super-expensive lawyers to threaten our group, and our families and also to threaten and intimidate the media companies who chose to allow us freedom of speech and expression.   Did you know there is no more Colonialism in Africa (or anywhere else for that matter?)

We, the simple Tanzanian’s, emailed you numerous times requesting – almost begging you – to clean up the mess of your company’s activities here, but you took no notice. Now you see how things have gone from BAD to WORSE for you all, because you have the WRONG Barrick-Acacia people working here in your local offices. These Barrick-Acacia people continue to try manipulate and behave all wrongly in the face of our new President, Dr. Magufuli.
These Barrick-Acacia think that they can “play the same games” and “pull the same tricks” and “make the same arrangements” that they did in the 1990’s and during the past 15 years until President Magufuli took office.

Just look at the terrible state of your companies here.  There are public charges of corruption, fraud, tax evasion, price transferring, falsifying export documentation – and no-one has forgotten the crimes of rape, murder, arson, environmental devastation and poisoning our rivers and water sources.  If all these charges are not enough, last week, a Presidential Commission returned their findings to our President – Acacia is GUILTY!

Yes, you all (top management at Acacia Mining and Barrick Gold) are all GUILTY of the crime of under-invoicing and deliberately manipulating and under-stating values whereby cheating our country from the export royalties that should rightfully be paid.

If you ask your lawyers they will confirm that in our country, these are crimes punishable with JAIL sentences.

Our President demands the resignations of his key people who fail him. You can learn from President Magufuli and demand the resignations of Kelvin Dushnisky, Brad Gordon & other senior directors and managers in Acacia Mining for their total failure to manage Acacia Mining ethically, morally and compliance to the laws of the land.
In addition, their resignations should be demanded for the guilty verdicts (twice) of tax evasion last year and even more so, the fact that last week, they have been caught under-invoicing exports, price transferring, false declarations of exports and should we include money laundering as well?

The question is if you have the courage and resolution that our President has, to demand the resignations from Mr Dushnisky, Mr Gordon, Deo Mwanyika, Charlie Ritchie and others responsible for the illegal activities in our country!  They can all run but they cannot hide!

Do you have any idea how much money you owe Tanzania from unpaid (deliberately) export tax royalties?  What about company taxes for real profits not declared (whilst you pay hundreds of millions of dollars in dividends overseas?  More crimes punishable with JAIL sentences.)

Your lies, deception, double standards and falsehoods late last year and early this year were directed mainly to romance Endeavour Mining to merge with Acacia Mining. Thank God for Tanzania that the merger failed.  We certainly don’t need Endeavour Mining management people here in our country!  But that’s old news and we prefer look forward.
It is no secret that for over a year Barrick Gold have been trying so hard to sell off its daughter company, Acacia Mining, but there have been no takers.  No other company in the world has been even vaguely interested in Acacia Mining – not because of the production but because of the terrible problems and scandals that surround Acacia Mining in Tanzania.  Now, Acacia’s complications are even worse!


Do you really think our President is worried about YOUR regular threats to close Buzwagi and Bulyanhulu mines?

Do you really think our President is worried about YOUR carefully initiated media reports in the overseas media referring to our President’s actions as:

     “….. thanks to Government incompetence”

How dare you insult our President and his Government when you are blatantly operating so illegally?

Mr. Gordon lied in the media trying to deceive Endeavour Mining regarding the extension of Buzwagi mine.  Did he really think that Endeavour would not do their own due diligence and be tricked into believing Mr. Gordon?

More deception and lies directed as a threat to our President was published just two weeks ago in the local media where your Buzwagi Mine general manager Stewart Hamilton said that Acacia will stop the mining activities in December 2017 while other plant processes will cease in 2020.  He was quoted, “According to our plan on the closure of Buzwagi Mine, we have decided to reduce the number of our manpower by 100 as an initial stage of the total closure in 2020”.

Mr. Thornton, just who are you trying to fool?
Your own people in the Acacia Mining offices who are so unhappy with your existing management are volunteering to assist our group with real information because they know the truth and the harm you are bringing on our country.  They told us your publicised plans make no mining sense at all!! 

Should we, “simple Black people” teach you, rich sophisticated White people, how to behave and operate with integrity and morality?
Mr Dushnisky, Mr Gordon and others from the UK and Canada will not step a foot into Dar es Salaam because they KNOW their crimes and they KNOW they will be prosecuted, even with their high-price lawyers fighting their battles.

We all know that its only a matter of time before Deo Mwanyika is called in by the Police and/or PCCB.
We all know how well you will create a “story” about this mess for your shareholders.  As our British boss always says:  You can fool some of the people all of the time.

Tanzanian’s are culturally peace loving people.  You cannot undo the past; you can pay for past mistakes and you can ensure the future is better.  However, for this, you need a clean broom.  A broom not associated with the corruption, fraud and commercial cancer from the past.  A new broom that you need to select and activate to start sweeping up the mess.  A new broom with a big budget and a clear, honest vision for the future.

ACACIA MINING SHOULD BE MORE TRANSPARENT TO TANZANIANS

TANZANIA ORDERS AUDIT OF MINING COMPANIES’ EARNINGS OVER TAXES

Dar res Salaam, Tanzania – 30th March, 2017:

A stop order issued by Tanzania Government on March 3rd 2017 barring mining companies to export copper concentrates for smelting outside the country has significantly exposed Acacia, which exports the stuff from Buzwagi and Bulyanhulu mining projects.
 
Acacia statement opens a can of worms.

On March 15th 2017 Acacia Chief Executive Officer (CEO), Brad Gordon responded officially pertaining to the Government order. The CEO is quoted expressing jittery for Acacia incurring loss of US$17 million (Tzs. 37 billion) in just two weeks of executing Government stop order. 

He is concerned if the stop order is maintained Acacia may fail to continue running operations because export of copper concentrates accounts for 50 percent of Acacia earnings from Buzwagi and Bulyanhulu mining projects. 

This statement exposes the vital information not previously disclosed to Tanzania Extractive Industries Transparency Initiative (TEITI). Actually, it opens a can of worms. Acacia is TEITI member with obligation to correctly disclose material production and Government payments information pertaining to its mining operations in Tanzania.
 
But reading Acacia statement we note the implication that Acacia had since TEITI launch (2009) disclosed only half the production and payments value data from Buzwagi and Bulyanhulu mining projects. 

And this sends bad signal to TEITI because it discounts material information and data compiled and published in the successive annual reports since 2011. 

The credibility of TEITI reports’ data and integrity of entire EITI work in Tanzania is exposed to irreparable risk if corrective remedies are not done in real time. Acacia has the obligation and should therefore come out immediately to patch up the anomaly.   
 
Acacia statement exposes a gap in the TEITI reports.

The quantity of gold or money value declared as having been produced or earned by Acacia and therefore payments made to government in the form of royalties, taxes, fees, levies, duties and statutory contributions should be correctly captured and documented in the TEITI reports. 

However, that may not be the case when we evaluate inherent logic exposed by Acacia statement. The payment data documented in the TEITI reports from Pangea Minerals Ltd (Buzwagi) and Bulyanhulu only present half the story. 

None of the six TEITI reports (2008/09 – 2013/14), has documented either quantity or value of copper concentrates, which according to Acacia, account for 50 percent of Bulyanhulu and Buzwagi revenue combined.
The documented evidence available at TEITI indicates during the 2012/13 fiscal year:
Pangea Minerals Ltd (Buzwagi goldmine) produced 205,240 ounces of gold worth Tzs. 520.9 billion (US$328,025,425)
Bulyanhulu goldmine produced 197,571 ounces of gold worth Tzs. 477.1 billion (US$300,413,402)
(TEITI Report 5th, 2015:11). 

Again, the data documented during the subsequent fiscal year show no difference. Bulyanhulu is recorded to have produced 192,550 ounces of gold worth Tzs. 430.5 billion (US$265,884,907) while Pangea Minerals (Buzwagi) produced 198,995 ounces of gold worth Tzs. 384,539,239,000 (US$237,516,516) (TEITI Report 6th, 2015:10). 

Not only are the quantity and value of copper concentrates exported from Buzwagi and Bulyanhulu missing from the duo fiscal years’ TEITI reports, but also are entirely not documented in the previous four reports.
 
There is one more controversial issue, which previously, Acacia hadn’t disclosed yet, but it is implied in the statement. The statement underscores that Acacia exports (sells) copper concentrates to foreign buyers rather than sending the stuff for smelting outside the country where appropriate technology is available. 

This means the ownership title of copper concentrates changes from Acacia to a foreign buyer immediately the stuffs are exported. This notion is new to Tanzanians, who hitherto held common knowledge that Acacia sends copper concentrates to foreign countries with appropriate technology for smelting the stuff, which whatsoever, wouldn’t involve ownership title transfer from Acacia to a foreign entity. 

That being the case, Acacia would be expected to report such significant transaction to TEITI because copper concentrates and gold are materially different. The local media quoting persons involved in the export of copper concentrates from the Tanzania Mineral Audit Agency (TMAA), Tanzania Ports Authority (TPA) and Acacia officials estimate 50,000 [8ft (2.43m) x 8.5ft (2.59m) x 40ft (12.2m)] containers of copper concentrates have had been shipped annually.    
 
Our Position and recommendations
The Coalition of Tanzania Civil Society Members of global EITI Association (TEICS) considers the amount of money raised from export of copper concentrate but Acacia hadn’t reported to TEITI for public scrutiny is significant enough to alter both TEITI reports and Government records of payment received from Acacia. 

Disclosure of these payments is even more urgent than ever considering Acacia nonpayment of Corporate Income Tax (CIT) since the company started (1998) operating in Tanzania up to 2016, on the ground that the company is still recuperating losses incurred during the investment startup phase.
         
We, TEICS, recommend and call upon:-
 
1.     That Acacia should disclose all details related to quantity and proceeds obtained from exports of copper concentrates since 2001 to 2017. Data presentation should comply with the EITI recommended pattern of data disaggregation – project by project and year by year – to allow and facilitate ease use by TEITI and Government.

2.     That TETI Committee should immediately start retrospective review and upscale all previous TEITI reports’ data to accommodate significant material information disclosed by Acacia reflecting proceeds from annual exports of copper concentrates.
 
3.     That the Government of the United Republic of Tanzania should assume leadership to evaluate the Mineral Development Agreement (MDAs) entered with Acacia to establish parties’ consistency and compliance with agreed terms therein, and thereafter, in consultation with Acacia, correct inconsistencies in the MDAs, if any, and ensure Acacia repays all the unpaid royalties, taxes, fees, levies, duties and statutory contributions resulting from exports of copper concentrates for entire period effectively from 2001 to 2017.    
 
4.     That the media should follow up and report to public about the actions taken by Acacia, TEITI Committee and the Government to correct the anomaly caused by Acacia not disclosing copper concentrates export business to TEITI and Government.

An open letter to President Dr. J.P. Magufuli, Chief Secretary, Attorney General, Minister of Minerals, TRA, and Canadian Prime Minister J. Trudeau and UK Prime Minister T. May, and Ministers and Ambassadors in both countries

Yesterday (Thursday, 23.03.2017) President Magufuli made a surprise visit to the Dar Es Salaam port.  He knew EXACTLY what he was looking for.  Even that the port officials tried to lead him in all directions “to inspect”, JPM knew that there were containers filled with gold mining ore “sand” waiting to be exported AGAINST his clear instructions about 3 weeks ago that there is a BAN on the export of the gold ore sand.   JPM found the containers.  All 20 containers.  All filled with ore sand. All ready in the port to export against the law of the ban. 
Our sources at the port tell us that a 40 ft container can hold a maximum of about 26,000 kg’s.  Total ore sand that JPM found is over a half million kgs.  How much export taxes and royalties in Tanzania losing from those 20 containers.

Once again, our President, Dr. Magufuli has shown the Tanzania People that the days of CORRUPTION and FRAUD are over.  TUMECHOKA!!   Tanzania again salutes our President for teaching us the new ways of the new Tanzania.  We praise our President for his courage and determination to stand up tall against anyone and everyone who will not keep the laws of our country.

On Saturday, March 4, 2017, The Citizen published their article “JPM BAN THREATENS 2 GOLD MINES”.  The 2 mines reported in this article are none other than Acacia Mining’s Buzwagi mine and also Bulyanhulu mine.

It is common knowledge that the mining companies, Shanta Gold and AngloGold Ashanti exports nuggets and not ore sand like Acacia Mining does.  There is only one company who has exported their ore sand for many years from Tanzania and who can generate such masses of ore sand like the half a million kgs in these 20 containers that JPM “caught red handed” in the port waiting for export COMPLETELY AGAINST the current ban!

President Magufuli and other Honored Recipients: 
One MUST ask who is responsible for this underhanded, illegal and mafia-style attempt to export 20 containers (or more) of gold mining ore sand? And the answer is obviously the CEO of the mining company and his subordinates who carried out his orders completely against the law.  Logic says that these individuals should be arrested and prosecuted for these crimes.  After all, if they are not prosecuted, what message is sent to our Nation of 55 million people?

If our sources in the Dar Es Salaam port are correct, and these containers are definitely from Acacia Mining, then Brad Gordon and his local team in Dar are all responsible and should be prosecuted without delay.  Maybe the Acacia team in London also?  We don’t know the law.  Maybe even the Chairman of the Acacia Mining Board, Kelvin Dushnisky?

Are we surprised?  Should we be surprised?  If the culprit is the CEO, Brad Gordon, then these mafia-style operations are definitely no surprise.  In July 2016, we wrote a research report about Brad Gordon’s failures and his immoral and maybe even criminal background. In March 2013, the media exposed a report of Brad Gordon (at that time, the CEO of Emporer Mines) intimidating the Intrepid partner (at that time), Mr. Paul Willis, and forced him into signing a release for his rights to their project  in Indonesia. The report stated that Mr. Willis was outnumbered nine-to-one, including Intrepid CEO, Brad Gordon, and legal counsel Vanessa Chidrawi and six locals, armed with revolvers in holsters.
The Business Day claims they obtained an email to show how Intrepid conspired with the local partners to squeeze Paul Willis out of the venture.

So Brad Gordon is no stranger to mafia–style business.  Revolvers? Intimidation? Conspiracy? Corruption? Fraud? Tax evasion? Transfer Pricing?  Can anyone blame our Government for refusing to deal now with this man?  Is there no shame at all in the Barrick Gold and Acacia Mining offices in Canada and England?

How many years have Acacia Mining been exporting these containers of gold mining ore sand?  How many hundreds or thousands of containers over the past 10 or 15 or more years?  If these 20 containers seized at the port hold over half a million kgs of this ore sand, how many hundreds of millions (or dare we write billions) of kgs of this ore sand did they export?  How many hundreds of millions of US Dollars have been deprived from our country?  How many schools and clinics and water supply lines and sewerage systems and power stations and bridges and roads and all the other basic needs that any country deserves?

President Magufuli and other Honored Recipients: 
The biggest slap in the face to our country, is Acacia Mining’s latest attempt (yesterday) to mobilize worldwide support AGAINST our great President, Dr. Magufuli.  Reports in the UK Telegraph, Reuters, NasDaq, Guardian, Financial Times and many others, in which they complain about losing US$1 million every day due to the export ban of the gold mining ore sand.

Is it Tanzania’s fault that for so many years, Acacia have exported the gold mining ore sand overseas and NEVER sent back the royalties for the gold extracted from that ore sand?  Why did Barrick Gold steal the gold from us that was camouflaged as ore sand and keep all the monies for themselves without paying our small export royalties?

The Telegraph suggests that our President’s agenda to ban the export of the gold mining ore sand may be “to help it develop a domestic smelting industry”.   They continue to write “previous studies have suggested that such an industry would struggle to compete with rival countries, while experts believe it could take a minimum of five years to build the necessary infrastructure.  During April we will reassess how long we can continue to produce as normal if the ban remains in place and what other measures may be necessary,” the company said.

Is this Acacia Mining’s way to scare our President?  Are they subtly send negative messages to scare off potential overseas investors looking at Tanzania?  Is this their way to try and belittle our President in the eyes of world leaders?  What will Prime Ministers Justin Trudeau and Theresa May comment to our President if they meet and this subject comes up in discussion?
How can they justify to our President that their countrymen’s attempted illegal exports under an official ban is acceptable?
And can they say that their countrymen’s tax evasion is OK by Canada or British standards?
And the corruption and fraud?
Shall we continue?
Even we simple Tanzanian’s understand the picture of what Barrick Gold and Acacia Mining are trying to manipulate here in our country and to damage world opinion of Tanzania.

But we have a new Sheriff in town and he is not falling for any of this.  Last year, our “Sheriff” publicly told overseas gold mining companies to “go home” if they complain they cannot make profits here and pay their taxes fairly.  On Thursday, whilst at the port, standing by the 20 containers seized before export, he said again that it’s by far better to stop mining gold here until Tanzania acquires the necessary knowledge to mine, instead of being crooked (referring to the non-payment of export taxes).

The People of Tanzania stand behind our “Sheriff”, President Magafuli, and we are confident that he will lead us to a better quality future.

Report to President Dr. John P. Magufuli about the threat letter from Acacia Mining

 

Dear Dr. Magufuli

The following is an extract of the threat letter that was received from Acacia Mining lawyers in London called Quinn Emanual.

The Company is acutely aware of the importance of developing its assets in a responsible manner to aid in the development of Tanzania and of its local communities who benefit from its operations. This has included over $35 million of direct investments into the Company’s local communities over the past three years.

The Company requires its directors, officers and employees to conduct their affairs to the highest possible ethical standards and to operate at all limes in accordance with all applicable laws, rules and regulations.

In short, Acacia is proud of its very substantial economic and human investment in and contributions to Tanzania and its people, and wishes to develop its business lawfully in Tanzania to the benefit of all stakeholders and in close cooperation with the Government of Tanzania.

The damage you are causing to the Company’s business directly affects Tanzania, through harm to its reputation and impact to the Company’s taxation contributions to the Governments revenues and all of the Company’s other stakeholders, including its employees (most of whom are local Tanzanians), its local communities, and its shareholders.

In the event that you do not cease and desist, we are instructed to commence such proceedings as are necessary to seek disclosure of your identity, injunctive relief, damages for losses caused to our client and reimbursement of court costs and lawyer’s fees. Your liability and exposure under such legal action could be considerable.


The sadness in this threat letter is that these super-intelligent and high power millionaire lawyers sitting in their luxury offices in London don’t even know what their clients are doing in our country.  They prefer to receive instructions from rich clients like Acacia Mining and send threat letter to ladies who earn salaries a fraction of one percent of their fees to Acacia Mining and then threaten us that we will have to pay them for damages and losses to Acacia Mining reputation?  That is both funny and bizarre.

Last month around 13 January, The Guardian reported in their Tanzania ippmedia website an article with website heading:
POVERTY ABOUNDS VILLAGERS SHARING BORDERS BARRICK GROUP.
It is a very sad but real article about our “Mining Bad Boy”, Acacia Mining.  The article is written by another BRAVE journalist, Neema Mugheni.

As you can read online, Neema received some money from the Tanzania Media Fund (TMF) which gave her the possibility to research and write the article.  Here are a few paragraphs of Neema’s article online:

For about a score (20) of years the mine has been in operation as the miners ferry whatever they mine abroad, leaving little and big caves in the country.

What has been worse is the pathetic situation of the villagers that surround the mine, who live in abject poverty, while many go without jobs, safe water, good schools and even proper medical care due to lack of well founded infrastructure.

The funny thing is that gold is gone and the residents still remain where they are. Many stories have been filed about this gold mine in northwestern Tanzania, and big international awards won from the reports, but life of the wananchi has littly changed.

One of the journalists who have filed reports on this lopsided state of affair is Neema Mugheni, a reporter with Kahama FM, a community media based in Kahama District, Shinyanga Region.

She did so after she received funds from the Tanzania Media Fund (TMF) to enable her to probe the reasons behind the poverty engulfing the villagers bordering Africa’s biggest riches.

The TMF verifying team which visited the area found that during her assignment, she visited three villages namely MWIME, CHAPULWA and MWENDAKULIMA where she interviewed many villagers in the areas.

Among them were the ward council chairperson Emmanuel Pius, Kahama District Municipal Director Anderson Libumba, the District Commissioner, as well as the District Medical Officer at the health centre whose infrastructure, was at the time, in a very pathetic situation.    Areas of focus for her programmes were jobs, social services such as health, water supply as well as the infrastructure.

During her interviews, complaints were abound by residents, especially youth that they had no jobs. According to them, only a few lucky ones were employed as security guards.

During the interview, the Village Executive Officer Vicent Ndesekio that lack of pertinent skills was partly the reason why many residents in the area were going without jobs.

Samantha Cole did not write this article about the terrible POVERTY of our People around Acacia Mining.  But it is nothing new and our People are talking more and more about it in Tanzania.  They talk so much about it that Acacia Mining choose to pay US$ 2 million for TV and radio and newspapers to make adverts about how wonderful is Acacia Mining.

You see how poor is Acacia Mining’s opinion about Tanzanian’s that they think they can make national propaganda for US$ 2 million and that will fix the poverty of our communities? And the TV adverts will bring our People clean water? And will the newspaper adverts fix the damage to our environment?  President Magufuli, you have lead your Nation into a NEW Tanzania.  These Europeans are still living in the times of colonization.

With all their billions of Dollars, you would think they realize this mistake? 

President Magufuli, will these London high power lawyers also send to the Guardian and IPPMedia the same threat letters that they sent to AllAfrica.com?

And will our friend, Neema Mugheni also receive a threat letter like they sent to us?
And Emmanuel Pius, Anderson Libumba, Vicent Ndesekio and others who dare to tell the truth about the real situation around the gold mines?  Will they also receive a threat letter like they sent to us?  And how can Deo Mwanyika, Vice-President of Acacia Mining, look in the eyes of any Tanzanian and justify this terrible bullying and intimidation?

The threat letter they sent us states we are causing damage.

Who is responsible for all the problems of Barrick Gold and Acacia Mining?  Did Samantha Cole cause such problems?
Did we ask Barrick and Acacia to do tax evasion?
And they murder and rape our People?
And they denied that maybe as many as 52 of our people in 1996 were victims of forced evictions and BURIED ALIVE at the Bulyanhulu gold mine in Tanzania?
The list goes on and on and on and on… these ‘innocent mining angels’ who wrote in their threat letter to me how WONDERFUL they are to our Nation BUT really, they are not and our People woke up and we all say :  TUMECHOKA 

That is what Samantha Cole is doing and Acacia Mining demand that we (all our group around the country) must stop OR ELSE they will start legal action and make me pay for the damages.

We wrote many times we need international companies here and we pleaded with Barrick Gold boss and Acacia Mining boss to work in Tanzania with a WIN-WIN relationship for our People.
That is the OPPOSITE of causing damages.  That is promoting cooperation.

On Friday (2 days ago), there was a report on the website of African Intelligence.  They wrote that the Minister of Mines in Kenya, Dan Kazungu, remains skeptical unconvinced about Acacia Mining in Kenya.

Africa is changing. The Nations are seeing the realities much more clear than before.

Facebook and social media is helping us to understand the problems better on a national level.

President Magufuli, what better way is there for the Wananchi (our Nation) to be a living part of the development of the NEW Tanzania if not through knowledge and understanding?
The Late Mwalimu, Julius Nyerere taught:
You cannot develop people. You must allow people to develop themselves.
This is what is happening in the NEW Tanzania and Barrick Gold and Acacia Mining cannot accept this.  And what will happen when they bring Endeavour Mining to their table as well?

Should our Nation be afraid?

No threat letters are necessary. No bullying and no intimidation.   No fear and no pressure.  God blessed our country with gold.  President Magufuli, we all remember your speech from June last year where you said it was better to stay with the country’s precious gems even for a thousand years, insisting that it was not a sin to leave the pits for the next generation.   Barrick Gold and Acacia Mining must thinking that you were making jokes because they don’t recognize your strategy at all.

Time is here and now for changes to make a WIN-WIN situation for the People of Tanzania and the mining companies.

This is the NEW Tanzania and we wrote many times in our blogs that we need mining companies here BUT not to work with human rights crimes and not in a corrupt and fraud way and not damaging our environment and not avoiding taxes, and, and, and……….

Now Barrick Gold and Acacia Mining sending their UK lawyers to threaten us because they know that there can be no merger unless they clean up their mess in our country.  The mess is made only by them so why are they looking outside their house?

The colonization days are finished. Please work in our country according to the values and integrity of Julius Nyerere, our ultimate Mwalimu.  He taught us the following:
Cooperation and conflict are two sides of the same coin; both arise out of man’s relationship with his fellows. The larger the group, the greater the possibility of development through cooperation, and the greater the possibility of conflict.
If real development is to take place, the people have to be involved.

We do not seek conflict.  We seek cooperation which brings trust and growth.
When will Acacia Mining see how well all their Tanzanian workers will give them service when the workers know that Acacia is cooperating with our country?
The Acacia mines will bring more fruits and the communities near the mines will become partners in the growth all around.
